1. Parties and acceptance
These terms are between you and MyPerkCard. They apply when you create an account, use MyPerkCard, or add a MyPerkCard pass to your wallet. The MyPerkCard service is operated by:

If you are a business, you use MyPerkCard through an organization. You confirm that you are authorised to bind that business to these terms. If you are a customer, you use MyPerkCard to hold loyalty cards from the businesses you visit.
2. The service
MyPerkCard lets businesses create loyalty programs and memberships. It lets customers hold the resulting cards in Apple Wallet or Google Wallet, without an app. Features vary by plan, as described on our pricing page. Apple and Google are not responsible for MyPerkCard, and their wallet terms also apply to you.
3. Accounts, organizations and staff
- You are responsible for keeping your login secure and for all activity under your account.
- Businesses act through organizations. The business owner is responsible for who they invite and which role each person holds.
- Staff use MyPerkCard on behalf of the business. The business is responsible for its staff's actions in the service.
- You must provide accurate information and may not impersonate others.
4. Plans, billing and cancellation
Plans are billed monthly in advance through Stripe. Prices are in euros and shown excluding VAT where applicable. VAT is calculated at checkout by Stripe Tax.
Current plans and prices are listed on our pricing page. The price that applies to you is the one shown when you subscribe.
There is no long-term contract. You can change or cancel your plan at any time in the billing portal. Cancellation takes effect at the end of the current billing period, and you keep paid features until then. [Refund policy to be confirmed.]
5. Free plan limits
The Free plan includes one loyalty program, a limited number of customers, basic Wallet support and basic staff scanning. We may change these limits with notice under section 11. Plan features are listed on our pricing page.
6. Acceptable use
- No fraudulent stamps, points, redemptions or fake customer accounts.
- No attempts to access other businesses' data, bypass rate limits or interfere with the service.
- No unlawful content, spam, or misuse of customers' personal data.
7. Loyalty programs and rewards
Each business sets its own loyalty rules, stamps, points and rewards. Rewards are offered by the business, not by MyPerkCard. The business is responsible for honouring them. MyPerkCard does not guarantee that a business will accept a particular reward. Businesses must follow the consumer and data protection law that applies to their programs.
8. Data processing
For personal data about a business's customers, the business is the controller and MyPerkCard is the processor. These terms are our data processing agreement under Art. 28 GDPR. By using the service, the business agrees to the following:
- We process personal data only on the business's documented instructions. Using the service as designed is an instruction.
- Everyone who processes the data for us is bound by confidentiality.
- We implement the security measures described in our privacy policy.
- We use only the sub-processors listed in our privacy policy. We will give notice of any new or replacement sub-processor, and the business may object on reasonable grounds before it takes effect.
- We help the business answer data subject requests. The business can export or erase a customer through the dashboard. Customers can also contact us directly.
- When the business deletes its account, we delete its data as described in our privacy policy.
- We notify the business of a personal data breach without undue delay after we become aware of it.
- On request, we provide the information needed to show that we meet these obligations, and we allow reasonable audits.
9. Availability and support
We work to keep MyPerkCard available, but we do not guarantee uninterrupted service. The Free, Starter and Business plans do not include a service level agreement. We provide the service on a best-effort basis. Pro includes priority support. We may change features with reasonable notice, and we will not materially reduce paid functionality without giving you the option to end your subscription.
10. Intellectual property
MyPerkCard, including its software, design and brand, belongs to us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the service for your own business or personal purposes while you follow these terms. You keep the rights to the content you provide, such as your logo and program names. You allow us to host and display that content to run the service.
11. Changes to these terms
We may update these terms. For material changes, we will give businesses at least 30 days' notice by email or in the dashboard before the change takes effect. If you do not agree, you can delete your business before the change takes effect. Other changes take effect when we post them on this page.
12. Termination
A business can end its use of MyPerkCard at any time. Choose "Delete business" in Settings. This deletes its programs, customer cards and history, staff access and custom domain, and cancels the subscription. A customer can end their use at any time with "Delete my account" in their profile.
We may suspend or terminate an account that breaches these terms. After termination, we handle data as described in our privacy policy.
13. Liability
To the extent the law allows, our total liability under or in connection with these terms is limited to the fees you paid us in the 12 months before the event that caused the claim. Nothing in these terms limits liability that cannot be limited under applicable law, including mandatory consumer protections.
14. Governing law and venue
These terms are governed by Danish law. Disputes are heard by the Copenhagen City Court (Københavns Byret). This does not limit any mandatory consumer protections that apply where you live.
